Throughout the website, the terms "us", "we" and "our" refer to www.dragonart.es. www.dragonart.es offers this website, including all information, tools and services available for you on the site, the user is conditioned to the acceptance of all the terms, conditions, policies and notifications herein established.

On visiting our website and/or purchasing a product, you participate in our "Service" and accept the following terms and conditions ("Terms and conditions of use", "Terms of service", "Terms"), including all additional terms and conditions and the policies to which reference is made in the present document and/or accessed via hyperlinks. These Terms and conditions of use are applied to all users of the site, including those users who are browsers, providers, clients, mercants, and/or content collaborators.

SECTION 1 - GENERAL CONDITIONS

By using this website, you declare that you are of adult age in your state or country of residence, or that you are of adult age in your state or country of residence and you have given us your consent to permit that all of your underage dependants may use this website. It is not permitted to use our products for any illegal or non authorised purpose. It is not permitted, whilst using the service, to violate any law in your jurisdiction (including, but not limited to Copyright laws). Computer viruses or any destructive code should not be transmitted. The non compliance or violation of any of these Terms will result in the immediate cessation of your services.

We reserve the right to refuse service to any person, for any reason and at any time.

SECTION 2 - ACCESS AND SECURITY

Access to the services requires previous registration by the user, once the General Conditions have been accepted, they will be considered to be clients.

The client's identifier will be comprised of their email address and a password. It will be necessary to include an email address, aswell as a password of minimum five characters, to create access to the client's personal account.

The use of the password is personal and non transferable, the assignment, although temporary, of the password to third parties is not permitted. In this sense, the client promises to use the password diligently and to keep it secret, assuming all responsibility for the consequences of divulging it to third parties.

In the case that the client knows of or suspects the use of their password by third parties, they should renew their password immediately, using the procedure in the website.

SECTION 3 - CONDITIONS OF SALE

The client recognises that they are informed, at the time of making the order, of the particular conditions of sale displayed on screen (name, price, components, weight, quantity, colour, product details, cost of services, etc.) and expressly declares acceptance of the same with no reservations whatsoever. The completion of the order and its confirmation by the client signifies the full and complete acceptance of the particular conditions of sale, exclusively applicable to the order.

Once having made the selection of articles, the forms of payment and dispatch are chosen. Before making an order, you should create an account by completing a form with your personal details, or sign in using your password in the case that you are already registered, to finalise your order. Once this process has been completed a message will be sent to your email address with all the details of your order. If your email is free webmail (Hotmail, Yahoo, Terra, Gmail, etc.) it is possible that this message may be stored in the Spam or "undesired email" folders.

Important: We recommend that you verify the order email which you receive to check that all the details of billing, dispatch, etc. are correct. This way you will avoid delays or incidents in the delivery of your order.

SECTION 4 - FORM OF PAYMENT

The forms of payment are by credit (or debit) card, bank transfer or PayPal.

4A. Bank transfer or Deposit

If you chooose to pay by bank transfer (o bank deposit) you will be provided with our bank account numbers to make the payment. You can make a transfer from your bank or building society or, if you prefer, make payment directly into our account with a bank deposit at one of the offices of our bank.

Payment of the order will not be considered to have been made until the total amount of the payment has been received in our bank account. You have 7 working days after making the order to carry out the transfer. Should the stipulated time expire without payment being made, www.dragonart.es will consider the order in question to be cancelled.

Please remember that payment should be made in EUROS and that any incurred banking commissions must be paid by you if you opt for this payment method.

SECTION 5 - SHIPMENTS AND DELIVERY TIMES

All deliveries are sent insured via the transport companies with whom we work or via certified mails for some small-sized products. The estimated delivery time depends on the destination (except for incidents generated by vehicle breakdowns or excess of orders due to active promotions). Delivery to isolated towns can be difficult and the dispatch companies may not go there on a daily basis, in which case the delivery could take longer.

Dispatch and delivery via the transport companies is carried out from Monday to Friday, except for public holidays. The delivery via certified mails is carried out every Tuesday and Thursday, except for public holidays. The shipping cost is automatically calculated at the time of making your order, depending on the destination and shipping method. To find out the exact delivery cost of your order select the products that you want to purchase and click "PROCEED TO CHECKOUT". Then select the destination and choose the method of payment and the shipping method. The total cost of your purchase will be displayed, including the shipping cost. At this point you can decide if you wish to continue or not with the purchase. Consult us if you have any questions.

Important: The estimated delivery times displayed for all shipping methods are counted from the moment that the order leaves our office. If your order hasn't left by 3 working days after order confirmation consult us and we will inform you of the estimated delivery time. Normally, all orders made and/or paid before 12:00 hours midday (Spanish time (peninsula - GMT+1)) will be sent the same day. The checking of payments by bank transfer can be delayed by a number of days. Payments by transfer can often take up to 3 working days to reach our account, and won't be processed until the amount is consolidated in our account (minimum 2 working days once the transfer has been made).

Very important: Indicate correctly your delivery address at the time of making the order, any change in address once the order passes the status of "Being prepared" will signify an extra charge of 5 euros as well as a delay of 3 días in the delivery of your order.

5A. Shipments to Spain (Iberian Peninsula)

The home delivery service is carried out using urgent transport companies, which make delivery in a timeframe of 24-48h for deliveries to within the Peninsula.

Delivery costs are free for purchases over 79 euros, and 8,65 euros otherwise.

You can also choose the alternative shipping mode: certified mail (only available for some products). The shipping cost is calculated depending on the weight of the products in the order. This cost will be clearly displayed during the purchase process, before the order is confirmed definitively. This delivery method will be more economical, but orders usually take longer to arrive (the delivery time is 1-3 business days; the delivery is carried out every Tuesday and Thursday, except for public holidays).

The delivery time is counted from the moment that the order leaves our office.

5B. Shipments to the Balearic Islands

The home delivery service is carried out using urgent transport companies, which make delivery in a timeframe of 48-72h for deliveries to the Balearic Islands. You can also choose the alternative shipping mode: certified mail (only available for some products), this delivery method will be more economical, but orders usually take longer to arrive (the delivery time is 1-3 business days; the delivery is carried out every Tuesday and Thursday, except for public holidays).

The shipping cost is calculated depending on the volume / weight of the products in the order. This cost will be clearly displayed during the purchase process, before the order is confirmed definitively.

The delivery time is counted from the moment that the order leaves our office.

5C. Shipments to the Canary Islands, Ceuta and Melilla

For sales to the Canary Islands, Ceuta and Melilla VAT will not be added (in the case of most products); however, the customs system will apply the corresponding tax charges that are to be paid by the client. In no case will we be able to determine the amount of tax to be paid by the client on receipt of his order, because, for example in the case of the Canary Islands, this depends entirely on the "aduanas de Canarias" (Canary Islands Customs and Excise). As a very APPROXIMATE estimation, and in no way fixed or established, between 15 and 30 EUROS is charged for importation rights and administrative customs documentation, aswell as the percentage corresponding to the I.G.I.C. of the Canary Islands. (We assume no responsibility whatsoever for any possible variation made by Customs without former notice). We are in no way responsible for these costs beacause we cannot assume them ourselves nor know with accuracy the amount to be paid upon receipt of an order.

Ceuta - 16,50 euros

Melilla – 14,84 euros

5D. International deliveries

For sales to foreign countries VAT will not be added (in the case of most products); however, the customs system will apply the corresponding tax charges that are to be paid by the client. In no case will we be able to determine the amount of tax to be paid by the client on receipt of his/her order. We assume no responsibility whatsoever for any possible variation made by Customs without former notice. We are in no way responsible for these costs beacause we cannot assume them ourselves nor know with accuracy the amount to be paid upon receipt of an order.

The home delivery service is carried out using urgent transport companies (only available for shipments to most European countries, the United States, Canada and most Latin American countries). You can also choose the alternative shipping mode: certified mail (only available for some products), this delivery method will be more economical, but orders usually take longer to arrive (the delivery is carried out every Tuesday and Thursday, except for public holidays). And the delivery times are as follows (the timeframe is counted from the moment that the order leaves the delivery companies' international platforms):

The delivery timeframe (The estimated delivery times are counted from the moment that the order leaves the delivery companies' international platforms to the date when the client receives the order) is indicative and refers to the destination’s main cities. Contact us for more specific delivery timeframe.

For the deliveries to Andorra, Gibraltar and Portugal, the shipping costs are free for purchases over 79 euros, and 8,65 euros otherwise. SECTION 6 - DELAYS IN DELIVERY

Although the majority of the deliveries are made in the indicated timeframe, occassionaly, delays may be produced in deliveries. If you have received a confirmation of the dispatch of your order by email but you still haven't received it, this could be because the courier couldn't find your address, because the courier came to your address when you were absent, or because an incident ocurred. Contact us, or the dispatch company that has been charged with the delivery of your order to resolve the issue as soon as possible.

SECTION 7 - DELIVERY INSURANCE

All our deliveries are insured against theft, loss or deterioration. If you observe any damage or manipulation of the package upon receipt please advise of it on the delivery note of the dispatch company. We request that you check your order upon receipt of the same. You must communicate any incident within 24 hours.

SECTION 8 - ORDER STATUS

From the "My account" section you can check at any time, the status of your order. Click on "Order history and details" and it will display one of the following states:

- Waiting for payment by bank transfer: You chose to pay by bank transfer and we are waiting for the transfer to be completed or made effective.

- Waiting for payment by PayPal: You chose to pay by PayPal and we are waiting for the payment to be completed or made effective.

- Waiting for payment by cheque: you chose to pay by cheque and we are waiting for the cheque to be cashed or made effective.

- Product out of stock (paid/not paid): The requested material is currently out of stock in our office and we are awaiting its arrival.

- Payment accepted (Remote payment accepted): Your order is being processed. In the case of payment by bank transfer, PayPal or bank card this signifies that your payment has been correctly received.

- Being prepared: The order is complete and is packaged, ready to be dispatched. (It is not possible to cancel now).

- Sent: Your order has been sent. (The order can't be cancelled now).

- Delivered: Your order has been delivered.

- Payment error: There is a problem with the payment of your order.

- Cancelled: Your order has been cancelled.

SECTION 9 - ORDER CANCELLATION

A cancellation is considered to be the annullment of an order by a client that has not yet been paid for, or which having been paid, has not yet been processed by our office, and consequently, has not yet been sent (orders with status "Waiting for payment", "Payment accepted").

To cancel an order you should send a notification by email as soon as possible to info@dragonart.es, stating that you wish to cancel your order and providing the order number.

If the article has already been paid for but hasn't been processed by our office, the payment will be refunded, any bank charges or commissions charged by any payment platform incurred by the refund will be paid by the client.

The user can cancel the buying process as long as it hasn't been fully completed and the product hasn't left our office. It is recommended that you contact us to assure that your order has been cancelled.

SECTION 10 - GUARANTEE AND REFUNDS

In the case of defective or incorrect products, all delivery fees will be assumed by www.dragonart.es for one month after sale in accordance with Guarantees (Law, 23/2003, 10th of July, ruling on Guarantees in the Sale of Consumer Goods and the General Law in the defense of Users and Consumers). However, with respect to oriental painting it must be realised that due to the nature of the materials used in their elaboration small paper folds are considered to be consubstantial to the artwork itself, and as they are spontaneous works they may differ somewhat to the example photographed by www.dragonart.es in terms of their shape and chromatism.

Attention: The guarantee does not cover the repair of damages due to causes external to the product itself (for example: accident, fall, ...), due to incorrect use or installation (not following the manufacturer's instructions) or use which may affect the proper conservation of the article.

Should you be unhappy about the management of a claim within the guarantee period or if you wish to communicate something regarding the product, you can always get in touch with us.

To proceed to change or return a product due to a product being defective or incorrect, you should sign in to www.dragonart.es, and send us a message via the "Contact us" form, selecting "Customer service" as the SUBJECT, and providing the ORDER REFERENCE and the PRODUCT which you wish to change or return.

Before sending us your article you should contact us so that we are aware of your dispatch and so that we may authorise your change or return. Package the product in its original packaging so that it is not damaged during transport.

Once we have received the package in our office and we have verified its condition, we will proceed with the exchange or refund. You can consult the status of said process in the "ORDER HISTORY".
